At the Land Appeal Court, held in Sydney on 12th inst., James Forrest, appealed against the local Land Board’s refusal to appraise the capital value of the added area of 140 acres of his co. Mr. Lake man appeared for the appellant. The appeal was sustained, and the Board, directed to re-hear the subject application for appraise ment, and include there in the area added to thee.p. Deposit refunded. On 14th inst. the above court gave its reserved decision in the case of Selina Annie. Holmes, who ap pealed against the dismissal of her claim for half cost of making rabbit proof the fenes between her hil. 85-19, Hillston North, and Wanga roa leasehold area No. 1, Western Division. The Court consid ered that satisfactory evidence had been given to show that the subject lands were within a rabbit infested district, and that the common boundary appeared to have been made rabbit-proof by the appellant in 1898, but there was also evidence to the effect that the owner (Mr. Bevan) was willing to pay his share of the cost and erection as soon as he was able. There was, however, no evidence of owner ship by appellant (as registered holder) of the subject ol at date of making the fence rabbit-proof, February, 1898, or at date of making her claim, January 8, 1902. According to the decision of the Full Court on case stated in Golds brough, Mort, Co. v. Gow, 8.C.R. for 1901, vol. 1, p. 36, the liability to contribute half cost of erecting a rabbit-proof fence commences, under section 20 of the Rabbit Act of 1890, at date of making the fence rabbit-proof, which was in February 1698, and as there was no evidence before the Board that at date appellant was the registered holder of the hl, she could not succeed in forcing her claim against the Board. The appeal was therefore dismissed, but the deposit refunded, threatens to be very severe thas winter. A meeting of the Cudgellico Farmers and Settlers’ Association was held, but no business of importance was transacted. Some of the members gave vent to their feelings over the auction of the Minister for Lands in appealing against some of the de cisions of the local Land Board at its last meeting. With the contingent that has just sailed for the seat of war goes another Cudgellico soldier, in the person of Mr. Fred Creswick, son of Mr. RB. W. Creswick, of Bogago. May 14,
