Mr. DaVis being very much intoxicated, called at the house of Mr. Kotiert Fluker# and having coded Air. F*. to the gate, after a few moments conversation, Davis became abusive, and finally assaulted Fluk^r* who being les* athletic, was badly beaten in tho affray—others in the mean time* interfered and parted them. Hut Davis still dissatisfied, again assaulted Flu-k^r* swearing that ho nuu» tied “to bear him to death/’ Fiuker, however*, by 2lii-« time had drawn a pocket knife, and w a ned Davis of the fact, and not to approach him, at tho peril of histifo. Davis ruslicd upon him—threw him, and while upon him. received a wound upon the side of I he throat, which dividing the jugular vein* he died in a f«w minutes.
