Thurs., May 13, 1976Gallegos denied request to suppress confessionA motion to suppress a confession signed by murder suspect Daniel Gallegos was denied Tuesday at a hearing before District Court Judge George Perez.Gallegos, 20, of Los Chavez took the stand during attempts by defense attorneys to have ruled as inadmis-ible certain documents Gallegos signed the night of his arrest Dec. 30. He was arrested in connection with the shotgun killing earlier that evening of Los Chavez bar owner Teofilo G. Castillo.Other persons who took the witness stand included Los Lunas policeman Larry Olguin, who was an officer with the Valencia CountySheriffs Office at the time of Gallegos' arrest, Los Lunas policefnan E. J. Jaramillo, also a deputy at the time, and William Johnson, currently an investigator with the Grants police department. He was commander of the Eastern Valencia County Metro Squad at the time of Gallegos' arrest.There was some discrepancy between Johnson's, Olguin’s and Jaramillo's testimony.The difference between Johnson’s and Olguin’s testimony arose over the time the confession was taken from Gallegos.The difference between Jaramillo’s and Olguin’s testimony concerned a photo shown to the only witness ofthe murder, Dowe W. Hobbs. The debate centered around whether Hobbs had seen a picture of Gallegos before he gave a description for a' sketch of the murderer. Olguin contended that the picture was shown after the sketch was made and Jaramillo, who made the sketch, said the picture was shown to Hobbs before the sketch was made.During the hearing Tuesday the question of whether or not Gallegos had been advised of his rights at the time of his arrest was discussed.Defense lawyer Raymond Sanchez has stated in the past that he plans to seek a change of location, outside of Valencia County, for the trial.It was pointed out during Tuesday’s hearing that Gallegos was escorted to the Valencia County Sheriffs Office before being advised of his rights.Describing the arrest, Gallegos said he had been sleeping the night of Dec. 30 when representatives of the sheriffs office and Metro Squad came to his house. He said they searched the house. Olguin testified that the search was done without a warrant, but with Gallegos’ permission.Gallegos told how he was taken to the Metro Squad offices and questioned. Up to that point, “nobody advised me of my rights at all, Gallegos said.He then explained that he was put in a lineup and then taken back to the Metro Squad offices where he signed some papers he said he had not read. These papers were confession statements. it was brought out in the trial.
