The- letter was finished before it was read. I never had Beecher’s portrait at my house in Clinton street. I never said to Beecher in January, 1871, what a grand thing it would he if Tilton and he could join forces in the Christian Union, In the interview with Beecher on the 3d of' February, 1872, I never said that he had wealth and friends at his b.ick and that Tilton was being borne down and no friends. 1 did not treat him with any coldness or severity on that day, and I do not think in fact I ever had any such interview as Mr. Beecher described. I was ill at my house at that time. Thrdugh the letter of February 5H1, 1872, 1 learned that Beecher met Tilton in the Cars.' 1 did not ask Beecher to appoint the arbitration committee for a settlement of all the difficulties. We talked about a settlement of the difficulties between Tilton and Bowen, and not those bstween Tilton arid Bcccher, and I did not suggest to Beecher the night of June 1st, 1873, that Kinsella should be sent for at the interview May 31st, 1873. Beecher didn’t denounce Tilton. On the night of December 30th, 1870, and at the interview between Tillon and Beecher, the latter did not ask me to be present. 1 never proposed the writing of the card suggested by Beecher, for Tiltou to present to the investigating committee. I never said to Tracy in November, 1872, in speaking of the letter of contrition that it was mere notes of a memorandum of a conversation I had with Beecher. Tracy didn't say 'o me that these papers seemed to imply that Beecher had been attempting the virtue of Mrs. Tilton without success. Tracy and I had no conversation on the sub-| jeet of improper proposals, nor was there any allusion 10 it except in sc far as the letter of retraction alluded to the subsent, nor did Tracy- suggest that Mr. Tilton's charge against Beecher was the result of misunderstand! ng. He never said a statement of facts should be made to some eminent citizens of Brooklyn. 1 never asked Tracy what could be done for Tilton if he made a statement of Ills case in this way. There was nothing said at the time of the arbitration about burning documents. T was present at the time that Gatlin expressed a desire that Bowen should sign the draft of the tripartite agreement at that meeting. Claflin said he did not care what was in Bowen’s soul—he must sign the agreement. Not^a word was said between the arbitrators other than about the business difficulties between Tilton and Bowen. The court here look a necess.Beach said that when Mis Moulton was on the stand he had intended to recall her. On conversing with her she said it she was on the stand site would swear that she did not say to Mr. Beecher that she would not believe the stories told of hint, and that she believed he was a good- man. The counsel-stated that the lady was ill and not able in appear 111 court, and the counsel 011 the 111her side had offered to accept this statement as if given in evidence l)y Mrs. Moulton. Evarls rose and agreed to this. Moulton resumed the witness stand. He testified: I did nottell Beecher, in reference to the Bessie Turner school bills, that it would be a good thing to help Tilton by paying them. Moulton then left the witness stand without cross-examination, and Stephen 1’earl Andrews was recalled, and identified the signature of Colonel Blood signed to .a lease of the offices o^j Mrs. Wood hull in 48 Broad stTeet from the 1st of May, 1872, to the 1st of May, 1S73.Cross-examined: I do not remember , what day Mrs. Wood hull moved from j 44 Broad street, but I think it was in the 1 latter part of May, 1872. This concluded Andrews’ testimony, and he took a scat in the audience, A long intermission j ensued here, which was broken by Beach saying, “We rest here, if your Tlonor please.”The defence began their sur-rebuttal by recalling James Freeland, who tcsti-I fied: 1 know Henry C. Bowen. Beecher . and he were nm at my house on the ; 26th of December, lS?*. They were in i January, 1870. i did not receive a note from Bowen on the 26th of December, 1S70, asking me to make an appointment with Beecher on that day.' Bowen was not at my house or. that day. I temember an interview between Be wen and Beecher at my house in January 1870. 1 recollect when the arbitrators met at my house, on that occasion 1 did not see the following paper: “We agree 10 submit to Joseph Freeland, II. 15. Claflin and Charles Stores, the question as to the amount of mipiey due Theodore Tilton from the Independent nod Brooklyn daily Union, in full for all claims and demands toahlilft 1'iV l\if‘it rl*i*tu4ivinme through -*his son, John Elliott Bowen, in December, 1870. Shearman showed witness ibe paper of submission said to have been submitted at the arbitration. Witness said that he nevei saw it before.
