Campbell, \Plaintiff, )Defendants. /THE STATE OF IDAHO, sends greeting to Benjamin A. S. Kent D., W. Rothrook, S. H. Lee and H. M. Rothrock:Tou are hereby required to appear in an action brought against you by the above named plaintiff in the District Court of the Seventh Judiolai District, State of Idaho, in and for the County of Washington, and to answer the complaint filed therein within ton days (exclusive of the day of service) after tho service on you of this summons, if served within this County; or if served out of the County, but in this District, within twenty days; otherwise within forty days, or judgement by default will be taken against you, according to the prayer of said complaint. Tho said action is brought to obtain a decree of this Court for tho foreclosure of a certain mortgage described In the complaint and executed by the said Benjamin A. S. Kent, on the 30th day of December, 1903, to defendant H. M. Rothrock, and by tho defendant H. M. Rothrock sold anil transferred to the plaintiff on the 30tb day of January, 1905, to secure tho payment of two certain promissory notes each of which is dated on the 30th day of December. IPO,, executed by defendant, beujumiu A. b. Kent to defendant H. M. Rothrock and each of said notes being for tho sum of Five hundred dollars, each bearing eight per cent interest from date until paid, and the first of said notes being due elevon months after date, and tho second one thereof being due twenty-three months after date. Both of said notes and tho mortgage oxe-executed on the same date to secuio the payment thereof being assigned, sold, and transferred to plaintiff who iB now the holder and owner thereof. And also to foreclose that certain lien for the sum of 819.89 taxes and 8170.00 interest on the prior lien of James Ruth paid out by defendant H. M. Rothrock to protect the mortgage lien herein foreclosed, and assigned by said defendant H. M. Rothrock to this plaintiff; and this foreclosure of said mortgage being made subject to the prior mortgage lien of one James Ruth for 82000.00 now existing on said premises described in said mortgage; the amount claimed in this action being as follows, to-wib: 81000.00 being theamount of the two said notes,together with interest thereon at 8 per cent per annum from December 30th, 1903 ; 8100.00 attorney and counsel fees;Mortgage.D.
