EAST ST. LOUIS, ILL., May 8 (UP)—An injunction suit brought by the Progressive Miners of Amer ica seeking to restrain the Pea body Coal Company officials and United Mine Workers from “con spiring against” the Progressives was dismissed by Federal Judge Fred L. Wham. Judge Wham dismissed the suit on the grounds that he had no jurisdiction. Attorneys for the Progressives argued their case March 17 and were instructed to submit briefs. The rights of the Progressives un der the NRA were ignored, the at torneys argued. They based their charge on the refusal of Peabody Coal Company Officials to bargain with Progres sive Miners. The Peabody Coal Company employs United Mine Workers. In Saline county Pro gressives claim that the miners want to work under Progressive contracts.
