WINNEBAGO, Neb. (AP) A spokesman for the Winnebago Indian Tribe threatened Thurs day to make ‘another Alcatraz” out of tribal land in Iowa being condemned for a federal recrea tion area unless the tribe receives some satisfaction in action to block condemnation. Reuben Snake, a member of theinnbago Tribal Council, said 210.4 acres of land on the east bank of the Missouri River is being condemned by the U.S. Army Corps of Engineers for use as a park and recreation area. The land has been appraised at $107,000. Snake aid the tribe isn’t ob jecting to the amount offered for the land, but contends that the tribe was never consulted about the instigation of the condemna tion proceedings. He said if the tribe isn’t given some satisfaction, ‘‘We’ll make that land another Alcatraz.’ Alcatraz Island, in San Fran cisco Bay and site of a former federal prison, was occupied in November by several Indians who claimed it as Indian land. The Indians on Alcatraz claimed the land on the basis of prior discovery—and therefore ownership regardless of subse quent treaties and settlements — and also referred to an 1868 treaty with the Sioux that gave the Sioux rights to unused sur plus federal property. Alcatraz was abandoned as a federal prison in 1963. The Alcatraz case does not in volve condemnation proceed ings but involves Indians laying claim to what they say was theirs and was wrongfully taken from them. Under condemnation proceed ings, as in the Iowa case, the government invokes the right of eminent domain which states that the public good will be served by taking the land from its owner with fair compensa tion. Snake said Thursday the tribe had called on U.S. Dist. Atty. Richard Dier of Omaha to take action to halt condemnation pro ceedings on the basis the tribe was not consulted before the proceedings were initiated. A spokesman in Dier’s office confirmed the receipt of a tele gram from Gordon Bauer, Win nebago tribal chairman, object ing to the condemnation and re questing action. But the spokes man indicated there was not much the U.S. attorney’s ofice could do in the matter at this time.
