NEFF TRIAL IN.Entire Forenoon Spent in Examination of One Witness,From Wednesday’s Daily Times-The jury in the case of the State vs. Omar F. Neff was empaneled last evening. But few of the regular panel remained. Juror Axtell was excused by the court on the declaration that he was unable on account of physical indisposition to serve. Judge Adair is anxious to have the case disposed of and a jury composed of the following gentlemen was empaneled last evening: H. M. Phillippi, John Warden,Virgil Young, William Thompson, Lawrence Yoder, Jonathan Hallett, J. E. Short. Mahlon Roach, Lewis Immel, C. N. Barnard, George Kapp, Christian Martin. Juror Domer, of the regular panel, was excused because he has conscientious scruples about fixiDg a prison penalty. This disqualifies the gentleman to sit in any criminal case. Neither side exhausted many of its preemtory challenges. After the state had made its statement to the jury last night court adjourned until this morning. When court convened today Juror Immel said he was sick and unable to sit and Charles Freeman was put in liis place. This necessitated considerable extra work, but it was soon gone through with and William Rinlcade, of Leesburg, was put on the stand by the state. This witness is the owner of the land upon which the loan was made by the Metropolitan Loan Savings Association, His testimony exonerated him from any attempt to swindle the company in covering up his indebtedness and the liens on the farm. The trial is likely to last several days. Judge Adair is very prompt in his rulings.Witness Kinkade was kept on the gridiron until after 2 o’clock this after-noon. His testimony was all on the transactions with Neff, the defendant, and he appears to know little about business matters. Uc Uooo not coom t.n remember his dealings in the loan affair very well, but insisted that he did get but $415 of the §1,820 for which he gave a mortgage.The next witness was John Grabner, a Warsaw merchant, who had been made acquainted with the transaction.E. W. Higbee, P. F.
