GILLON.His Wife and Relatives, However, All But Broke Down.—Appeal Will Be Taken.—Jury Disagreed as to the Punishment.Kosciusko.—The jury in the case of A. P. Magness, charged with the murder of G. W. Gillon, after being out about two hours, returned a verdict of “guilty as charged,” but disagreed as to the punishment, which means that a life sentence will be imposed.When the jury filed in a stillness pervaded the court room, and necks were craned and the large audience was aquiver with excitement. “Gentlemen, have you agreed on a verdict?” asked Judge Teat. “We have,” replied the foreman.When the clerk of the court read the verdict MagRess appeared not to be perturbed, but his wife and other relatives were pained. As two of the officers approached him for the purpose of carrying him to jail, the farewell to his wife and her sister and others was affecting. Several were in tears.A motion for a new trial will be made, and if overruled the defendant’s attorneys will appeal the case to the supreme court. The case was submitted to the jury without argument.Hon. J. A. Teat, the presiding judge, has earned the confidence and esteem of both lawyers and the public by his untiring energy, his firmness, and the impartiality of his ruling3 in the case.
