Booth acting ^.3 .cotr’sei for defendant* Witnesses were placed on the stand by the prosecution wlior testified to the fact that defendant had a wify living in Idaho and had married another woman In this Territory. Geo.Cunninchaxn.a justice of the peace in American Fork, Testified to performing the first* marriage* K, A. Hills testified that he was a member of the.grand jury that indicted defendant, who bad admitted the two marrages D. Evans, assistant District Attorney, took the stand and testified that he had received a letter, which was offered in evidence, admitting his guilt and his readiness to bo plead.Defendant took the stand in his own behalf. He stated that at the time he married the second woman he was under the impression that his wife had obtained a divorce, and had received information •to that effect.
