On Monday, March 7, the State House of Representatives voted 43-24 in favor of passing House Bill 797 entitled, ‘“‘An Act to amend SDCL 7-17-1 and to provide for a special election for the purpose of determining the status of the organization of Tripp and Todd Counties.” The bill, as passed by the House, reads: “Be it enacted by the Legisla ture of the State of South Dakota: Section 1. That SDCL 7-17-1 be amended to read as follows: 7-17-1. The unorganized county of Shannon is attached to the county of Fall River and the unorganized county of Washa baugh is attached to the county of Jackson and the unorganized county of Todd is attached to the county of Tripp for administra tion of governmental and fiscal affairs, including all state, county, judicial, taxation, elec tion, recording, canvassing and foreclosure purposes, excepting in cases where the administra tion of any of said affairs is expressly otherwise provided by law. Section 2. Section 1 of this Act shall go into effect on January 1, 1980 unless the voters of Tripp county and Todd county approve continuation of the attachment of Todd county to Tripp county in an election as provided by this Act. Section 3. There shall be a special election held in Tripp county and Todd county for the purpose of this Act at the General Election in 1978. Section 4. The election shall be held in the same manner and under the same laws and regula tions that apply to the general election. The county auditor of Tripp county shall be in charge of any such special election. Tripp county shall bear all of the costs of the election occurring within Tripp county and Todd county shall bear all of the costs of the election occuring in Todd county. Section 5. At such election, the question shall be phrased so that the voters will have a choice between severing Tripp county and Todd county or keeping Todd county attached to Tripp county as an unorganized county. Section 6. If a plurality of those voting in the special election in Tripp county and a plurality of those voting in the special election in Todd county both vote to “in the Todd count cing attached to Tripp county as an unorganized county, the provi sions of SDCL 7-17-1 relating to the status of Todd county and Tripp county shall remain in effect and section 1 of this Act shall be repealed. If a plurality of the voters in either Tripp or Todd counties vote against continuing Todd county being attached to Tripp county, then Todd county shall no longer be attached to Tripp county as provided by section 1 of this Act. Section 7. If section 1 of this Act goes into effect, the county highway board of Todd county is hereby abolished. There will be established in Todd County an elected board of supervisors consisting of three members elected in the same manner and at the same time as are county commissioners in organized counties. All functions formerly performed by the Todd County highway board will be trans ferred to the board of supervisors on January 1, 1981. Section 8. If section 1 of this Act goes into effect on or after January 1, 1981, the board of supervisors of Todd county shall contract ,with any organized county, including Tripp county, that all of the county services of such part as may be necessary, formerly performed by Tripp county for Todd county, shall be performed by the organized county contracted with and its county officials. Further, the Legislature shall, by the law, make appropriate provision for the governing of Todd county. Section 9. The state board of elections may adopt rules to implement the provisions of this Act and shall adopt a rule establishing the form of any ballot that will be used in any special election to be held in Tripp and Todd county under the provisions of this Act. Such rules may be adopted without neces sity of a hearing as prescribed by chapter 126 but the state board of elections shall give notice to the citizens of Tripp county and Todd county by the best means practicable of the date, time and place when such rules shall be considered and adopted by the state board of elections. Any such rules adopted by the state board of elections shall be temporary and shall expire January 1, 1979.’
