Georgia, February 10, 18(1*, pbtsuant to Special Orders, No. 27, Headquarters Third Military District, dated Atlanta, Georgia, February 3, 1808* and of which Brevet Brigadier General Bafos Saxton, Quartermaster U. S. Army, is President, w.is arraigned and tried : Berry T. Digby, Sheriff of Jasper county. State of Georgia.Cijakc.e I.—Wilful neglect of duty as Sheriff of Jasper county. State of Georgia.this: that Berry T. Digby. being Sheriffof Jasper county, in the State of Georgia, and having been notified that one Maria 15mwn, who was living on the premises of the said Berry T. Digby, had been murdered upon his premises as aforesaid; and having himself viewed the dead body of the said Maria Brown, within five minutes after the murder; and having been then and there informed by John Brown, the husband of Maria Brown aforesaid, and by others who were present, that Homcf Barnes, a. citizen of Jasper county, Georgia, had feloniyuwly and with malice aforethought comm‘tied the murder upon the person of the aforesaid Maria Brown; and the said Homer 13irnes being then and there present, and on the premises of thu said Berry T. Digby, be, the said Berry T. Digby, as aforesaid, did wilfully and unlawfully’ fail and neglect to arrest, or make any effort to arrest, the said Homer Barnca, and well knowing that the said Homer Barnes was endeavoring to c.cnpe, and was likely to make his escape before a warrant could be issued for his arresi. did wilfully permit the said Homer Barms to make his efcape, without pursuit or effort to arrest him.( This in the county of Jasper, State of Geor-•firt, on or about the lGtli day of January, 18GG *•To which Charge and Specification the accused pleaded* “Not Guilty.”1’IN DISO.Of the Charge and Specification “NotGuilty.” • **.And the Court doe* therefore acquit him.II.
