Hines Denied a Renewal of HisLiquor License._ The City Council met in special session on Tuesday night last, Major Dusenberry presiding. The only absentee was Councilor Hanson.# Councilor J. A. Brown presented a petition fiom IV. H. Brown and 110 others asking that the city property known as the adobe yard be set apart as a public park in pursuance of an-act of Congress.Ur, Brown moved that the petition be granted and that the chair appoint a committee of three to carry out the requests of the petitioners.It wag finally agreed, no motion of Mr. Daniels, to refer the matter to the committee on public grounds and city property for the purpose of ascertaining under what arrangements the property bad been come years ago appropriated to the use o£ the Utah County Stock Growers* Association. The committee were instructed to report to the next meeting of the Council.A petition wasread from W/N. Bnsen-berryjaskiag for the right to convey water through the city and Factory races to a Jot purchased by him from HT W. Davis, and situate on H. street, for manufacturing purposes. ^ Referred fco the committee on irrigation *Mr. Scott, for committee on finance, reported favorably on petition of E, ,OsterIoh, asking that his license as a restaurant keeper be remitted.Mr. Scott moved the adoption of tk« report;Mr.^Iaiben wanted to know if the committee understood the petitioner's circumstances. Mr. Maiben thought he had plenty money to spend.Ur. Scott said he was convinced theold gentleman was indigent and his circumstances such as to claim the indulgence of the council.Mr. A. D. Holdaway said it wag well knowd that Osterloh harbored boys in his house where they gambled and he,'the petitioner, went out and purchasedliquor for them.Mr. Maiben remarked that what Mr. Holdaway had stated were facts. Heweb in a position to know that boys had been permitted to gamble and drink in Gsterjoh’s back room.There was considerable discussion oyer the adoption of Mr. Scott’s recommendation to remit Mr. Osterloh*s license, and on the question being put the recommendation was rejected.lln Scott,for the committee on finance, reported favorably on the report of the poundkeeper which had been referred to them. The report was adopted, and the claim for services of tho poundkeeper was allowed.Mr, Maiben, of the committee on. license, reported favorably on the January statement of the auditor of licensescollected. The report was adopted.Mr* Pxman asked leave to present a petition which had just been handed to him. It was from B* Bachman, F. W, 0, Hathenbruck and B. Bachman, Jr., on behalf of the Board of Directors of the Provo Electric Light and Power Company, asking for a franchise of fifty years for the running of their lines through the streets of the city. The pe-tion was referred to the committee onjudiciary.The Mayor stated that the practice game3 of chance, raffies, etc., were becoming frequent and agitating public sentiment. ^ He referred to the ordinance on the subject and remarked that there were some doubts as to its application to the present situation. He had beea.ap-. proached on the matter by the'Marshal. The Mayor reeeommended that the Council and city attorney give their attention to the question of definition,etc.Mr. Scott had noticed while examining the auditor's report that peddlershad been granted licenses for a day and two days, while the ordinance plainly provided.that licenses should not issue lor less than three months’ time.An application _ was presented from W, M. Wilson, asking for a renewal of his license ras a saloon keeper. The application, on motion of Mr. Scott. was granted.Mr, Farrer complained that there was not sufficient promptness in making such applications, it occurring that sometimes applications lor renewal were madd after the applicants had been running business and that too without any license. He thought this neglect should,be stopped.Application of R* S. Hines for carrying on business at the Palace Saloon, corner of Seventh and I streets, was presented. This application had been referred to the recorder for the purpose of having a certain change made in the petition,Mr. Holdaway moved that the application bo not granted* It was understood that the Palace Saloon was not in the place stated by. the applicant. It was the purpose to dodge the ordinance.^ Mr. Maiben stated that Hines claimedthe light to carry on his liquor drinkingbusiness'in any part of the premises,either in the drug store on the comer or in the saloon in the rear; all the presa-ises were his, and he claimed it perfect' ly lawful for him to do that class of business on any part of the premises, either from the front or the back.Mr. Scott said the question was only little technicality,”Mr, Holdaway said it was evidently Hines' object, when a customer entered Ha drug store and called for liquor, to send into the saloon in the rear and get it. He believed in a strict observance of the ordinance^ which provides that the sale shall be in none other than *‘in the front room.” The speaker was ready to test this question, whether Mr, Hines can sell In one place while Ms licensed saloon is in another place*Mr .Brown said Hines wao ■certainly violating the ordinance when in taking out a license to sell “in the Palace Saloon on the northwest corner of I street,” he goes to work and sells somewhere else.Mr, Alexander said the citv had had trouble with Hines all along,In Ms opinion the Council cannot afford to grant the application as Hines makes It.Mr. David Holdaway thought it ought to bo defined by Mr. Hines which is his 1 drug store and which is his saloon.\ The question was put and the applica-_ | tion was thereupon denied.Petitions from a number of persons for remittance of water tax were granted, while about an equal number weredenied.Mr. Scott offered the following whichwas adopted: That the members of the Council be allowed $1 each for each attendance of the Council for tlie past year in accordance with the terms of the resolution of November 26,1SS0. f Council then'adjourned.
