On the way Daniels lost his hat, and there being some dispute about whether they should go back to hud it, Dauieis throw Penter out of the buggy and went back to search for the hat. He upset the buggy, and caused soma damage to it which ho had repaired afterwards at Diamond Springs. Later on J. C. Haald arrived, and noted the repairs, blaming the men somewhat for carelessness. After that Daniels quarreled with Penter about the accident, accusing him of telling lieald that Dauieis had broken the buggy, aud Penter denying that he was making such reports toSHeald. It is said that during this dispute Daniels struck Penter. At any rate ou Saturday Daniels was at a saloon at the Pay State mine, between Plymouth and Nashville, and became intoxicated, lie then came over toPadilla’s place, a mile or so the other side of Nashville, on the read toEl Dorado, where the found Penter. They drank wine.
