Uaniels went-to Pen-tei’a cabin about half-past eight andsaid, “Ted, you son of a b , comeout, I want to see you.” Thera was uo reply, and Uaniels proceeded to kick down the door. He broke the door open, stepped inside, still calling Penter vile names; there was a shot, and Uaniels reeled out of the door and died about 75 feet from the house.Penter remained in the hcuse, and was arrested by sheriff Cook a few hoars later.Penter and Uaniels have been partners in takiug care of or leasing some property at Nashville owned by J. C.Heald. Uaniels is a half-blood Indian, the son of Stephen K. Uaniels, who married an Indian woman at Nashville years ago and left a large , family. His ago was about 32, and . 8ayahe was one of the most powerful men | *a'r^y comin in the county, his height being over | six feet and bis' weigbt more tban 200 pounds without superfluous flesh. He a miner, and was assisted in winning many drilling contests. Penter is an older man, and not a match for the other in physiqne. He is registered as Edward Penter.These men went to El Uorado in Mr Heald’s buggy a few days before the shooting. Both became intoxicated before they started home. On the way Uaniels lost bis bat, and there being some dispute about whether they sbonld go back to find it, Uaniels threw Penter out of the bnggy and went back to search for the hat. He upset the bnggy, and caused soma damage to it which he had repaired atterwards at Uiamond Springs. Later on J. C. Haald arrived, and noted the repairs, blaming the men somewhat for carelessness. After that Daniels quarreled with Penter about the accident, aconsing him of telling Heald that Daniels had broken the buggy, and Penter denying that he was making snoh reports toJHeald. it is said that daring this dispute Daniels strnck Penter. He then went to his cabin, near the school-house, on tbe edge of Nashville.Uaniels heard that Penter was making threats, and started to find him. Two of his friends, Ed Hart and John Var-ozza, tried to persuade him to desist.He refused to stop, and they followed him. They heard him call Penter at the cabin, and noticed the latter’s light go ont. They heard Daniels kick the door down, then heard the shot.They saw him come out of tbe cabin, and when they reached him and strnck a match he was gasping in the last agonies. A 15-caliber pistol bail bad entered the left arm, just below tbe point of the shoulder, and had emerged near the right arm pit, passing entirely through the chest in the region ot tbe heart. Uaniels was bleeding at both month and nose when they found him.They lett the body where it was.and telephoned for the officers. When the officers, sheriff Cook and deputy Hand, arrived they found a group of people on the hillside awaiting develop ments. They had kept away from Fen-ter’s cabin, fearing that he would shoot under the supposition that he was attacked. The officers went to the cabin and hailed Penter, who made no resistance as soon as he beard they were officers, and they brought hiui to FJacerville.Penter is from Amador county, bis people living just below Plymouth years ago. Daniels leaves a wife and Hve children.The coroner’s jury heard tbe testimony of Hart and Varozza, and ren dered a verdict that Penter shot and killed the deceased in self-defense.Tbe jnrors wore William Shaw, D. C.Wickham, C. G. Celio, Oliver Hart.O. B. Peaseley, Wm. J. Hart, Thos,J. Higgins,David C. Polkinborne and James H. Eranklin.Like tha Georgetown case, this trouble arises out of intoxicating liquors. There will probably be no trial, as it seems clear that Penter was justified in shooting under the cironm stances. No arms were found on Uaniels or about the premises, and ha never was in the habit ot going armed as be relied on bis great strength and activity to carry him through his quarrals.
