Burton, a real estate agent, testified to the shooting, which he saw from mi upstairs window. He located the different eliofe up to the first four, saying W. J. ElligLt, the defendant on trial, tired the first allot, the second came from the crowd north of Osborne, the third shot was fired by Osborne, one of the victims of the defendants guns, and the fourth shot was fired by W, J. Elliott,The defendimt's shots were all to the north lt;*nd northwest. The testimony is in favor of the state’s theory that W. L. Hughes* the ixmrjc^nt bystander, was not killed by Osborne. Much time wasspent by too defense in endeavoring to bring out that there woa no women between the combatants, but the witness said up to the fourth shot there were several ladies, within * a radius of five feet of W. J. Elliott.Johnny Green, a colored boy of 12 ears; Dr, Tlt; B* Hillock, S. Hirsh, a barer; L. J. Gutke, of police court; Or. W. Dun, police board secretary; H, T, Irwin, of the Park girn store; J, M. Flemming, William Brown, clerk in the gun store, and Hugh Brady testified, all tending towards threats, selling of the fatal pistol and the mysterious movements of the prisoner prior to the murder.Very damaging testimony against W. J. Elliott was that submitted by Attorney James Miles in the afternoon. He said he was standing within eight feet of Osborne and saw the Elliotts come up. Bill Elliott advanced toward Osborne and fired two shots in rapid succession, one of which took effect in the xnouth, causing the blood to flow. Osborne then returned the fire, retreating while tlie man at whom he fired dodged behind a woman. .Witness saw Elliott' fire toward the north, ami at the same time Hughes fell. The cross-examination only strengthened the main points of his testimony, and other eye-witnesses that followed corroborated the above facte.
