The Rusk Case. The prisoner at the bar was put on the stand, and told its story in a clear frank manner as follows: “My name is Charles Rusk, a man orphan, my parents both dying when I was quite young and I have no recollection of either of them. Do not know how old I am. Have lived in this and Cass county during the last six or seven years except a short time in White county. Made my home at Adams’ last winter and teamed for him. The morning of the shooting Henry Nichols came to the house and I accused him of carrying tales to Ad ams that were untrue and that Adams had so informed me. Some other words passed, then I went into the next room and sat down to breakfast with the family, Nichols coming as far as the door, saying with a shake of the head, ‘I'm a bad one; he then walked around the table toward me, adding ‘I did accuse you and ‘ll stick to it’. Then I got mad and broke my plate and threatened to whip him. Adams then raised up, grabbed his chair and had it over his shoul der and was coming toward me when I shot him. I believe he would have surely killed me with the chair if I hadn’t shot. I had no quarrel with Adams before this. As he advanced toward me with the chair raised he exclaimed, “To smash our d—d head for you.” After the shot Mrs. Adams and Nich ols grabbed me, but I pulled away from them, got my cap and coat and left. I did not load the revolver in the kitchen. It was loaded when I got it of my sister-in-law the week be fore. I paid thirty cents for it. I did not threaten to shoot Mrs. Ad ame. The testimony closed with Thurs day’s session and argument by coun cil commenced this morning. Pros ecutor Kirkpatrick opened for the State, followed by Shirley and Har ness for the defense. Blackridge will close for the State this afternoon, after which the Judge’s charge will be delivered and the case turned over to the jury. A verdict is expected with a few hours deliberation. The defense entertains no hope of acquit tal, and on the other hand a severe sentence is not anticipated by the at torneys for the State.
