Evi- j dence taken showed tlmt the watch belonged to Mrs. Eva Williams and that she gave it to Fillner for safe keeping, and he had not taken it as the complaint charged.Mrs. Eva Williams swore that the watch belonged to her, being left her by her deseased husband, and that shetook it from the house and gave it to Fillner on July 11 for safe keeping.William Webber, who made the complaint, is Mrs. William’s uncle. He stated that before his death* Mr. Williams promised him the watch- No such promise was reiterated after the marriage, however. he; admitted.On the basis of these facts, Judge W. H.
