MYER LY; AND WHOMSOEVER ELSE IT MAY CONCERN,Defendants,To each and all of the named defendants:You are hereby notified that there is now on file in the office of the Clerk of the District Court of Dickinson County, Iowa, at Spirit Lake, the petition of the plaintiff in the above entitled action in which the plaintiff alleges that the named defendants are owners of certain tracts of agri cultural property presently lo cated within the boundaries of the Incorporated Town of Wah-peton, Iowa, the names of theowners and description of the respective properties owned by each being as follows;PETER B, NAREY - NE% of SE’A; NW’/4 of SE/4, SW'A of SE*/4; and SE/4 of SE‘/4; all In Section Fourteen (14), Township Ninety-nine (99), Range Thirty-seven (37), Dickinson County, Iowa,MARGARET E. BARBEE AND EDGAR L. BARBEE -SW% of NE*/4 and Gov't Lot Two (2), all in Section Fourteen (14), Township Ninety-nine lt;99/, Range Thirty-seven (37); also known as South Half (S'/z) of Section 14, Township 99, Range 37, in Dickinson County, Iowa. MABELLE J. MYERLY and JAMES W. MYERLY - Lot Ten (10) of the Official Plat of Blocks D, E, G, H, I, J and F, except Lot 6, Block F, and Lots Ten, Eleven and Twelve (10, 11, and 12) Block ‘-B, Plat of Manhattan Beach, Dickinson County, Iowa.Plaintiff alleges that said tracts are unimproved except for a small frame building in the southeast corner of the Myerly tract: that there are no residents living upon any of said properties; that they are devoted entirely to agricultural purposes; that the areas cannot reasonably be needed in anticipation of further growth of the plaintiff municipality and need not be retained for sanitary purposes; nor is it necessary that the town have jurisdiction of the properties for purposes of policing tho same; that the town does not furnish utilities to said areas nor otherwise contribute anything of value to said areas. Attached to plaintiff’s petition is a plat of the areas showing the relationship thereof to the corporate limits and other areas of said municipality.
