by DARRIN STINEMAN Staff Writer Rhonda Bess Simon’s estranged husband settled out of court for $50,000 after suing her for the wrongful death of their three children. Michael Simon sued for an unspeci fied amount in excess of $50,000 but agreed to accept $50,000 from Rhonda Simon’s insurance company, USAA Ca sualty. Rhonda Simon, 30, was convicted of vehicular homicide and aggravated battery and has served 22 days in jail for causing a Nov. 27 drunk driving ac cident that killed her three children. She remains on a three-year probation program that includes in-patient alco hol treatment. Michael Simon filed the suit based on his wife’s “wanton and reckless dis regard for the safety and welfare of the children.” Hailey Linn Simon, 7, Maralyn Rea gan Simon, 6, and Thomas Blu Simon, 2, died when they were ejected from the 1974 Datsun their mother drove into the path of a semi truck. Simon, who ran a stop sign at the intersection of Schul man and the U.S. 50 bypass, had a blood alcohol level of .15. Legal limit is .08. Michael Simon filed for divorce on June 13, citing incompatibility as grounds. The Simons were married in September of 1987.
