I8th June, not being bona fide travellers or lodgers. Sergt. Swan prosecuted, while Mr. Pollack appeared for defenadtns.CANTISamuel West, foreman on the Grafton and South Grafton Nymboida water supply, residing at South Grafton. deposed: I was on the licensed premises on the Sunday in question with Brown: I went there to ring up Dr. Henry, as I had been suffering with lumbago, and could not walk properly; I was not able to work until yesterday; on the Sunday morning in question I went to my office in Trough -street, endeavoured to do some writing, but found my back too bad; went along Skinner street and met Brown, whom I asked to accompany me to the •phone, as I wanted to ring up Dr. Henry; we went into the telephone room: while I was looking for the telephone number Sergt. Caiman came to the door: the room is 7 x 9: the sergeant said You're very smart men: what are you doing here, West”: I said I came t.o ring up I)r. Henry; he said It’s a wonder you would not use the public telephone, and T said I did not have the twopence, but I had permission to use the ‘phone whenever I liked: the sergeant said You had better get out; the longer you stay here the-worse for yourself: you will get a summons as it is; in the back pardon the sergeant said to Brown Mrs. Durrington was standing In the hall—What are you doing here?1' Brown said I am here for the present we walked into the yard, when the sergeant said to Brown. Come back and explain yourself, to which Brown made no reply and we walked away:I never went there to get drink: my back was bad. and I went to the chemist and got a plaster; it continued bad. and I consulted Dr. Henry Wednesday morning.To Sergeant Swan: When people ring me up, I receive the message when I call, or when it is given me as I pass; Durrington gave me permission to use the 'phone, not his wife: there was no third party went with us; Dr. Henry had not previously attended me prior to Wednesday: it did not strike me a chemist would be able to tell me whether a plaster would do me good: 1 suffered for three days before seeing the doctor; I asked Brown to enter the hotel at my Invitation, as I did not want to leave him standing In the street; it did not occur to me to tell the sergeant that Brown was there at my request; I may have used the public telephone before: I could not pay I would have used the public telephone if 1 had the money: I heard the sergeant say to Mrs. Durrington something about a dog, which was the only conversation I heard: I did not ring up the doctor because the sergeant ordered me out: it was after I had been served with a summons that I consulted Dr. Henry.Joshua Brown, a butcher, said he was on the premises on the Sunday referred to, hut not with the intention of obtaining liquor. He generally corroborated the evidence given by West.To Sergeant Swan: He knew it was an offence to be on licensed premises on Sundays. It did not occur to him to make an explanation to the sergeant when the latter asked him. Did not tell the sergeant that he was staying at the hotel. He said Mrs. Dur-rlnglon told the sergeant that she cnuld assure him she did not know tbev were In the place.Mrs. Durrington, wife of the licensee of the Post Office Hotel, South Grafton, stated she was In charge when the sergeant came. He asked her If she saw defendants at the hotel that mornings and she said she had not. He went through the place and on returning asked her to go with him. They found defendants in the telephone room. She told the sergeant that West had permission to ring up on the ’phone. Others had similar permission. The bar was locked, and there was no possibility of obtaining liquor.William Murray stated that West was engaged by him diving for stone near the Council’s crusher at Grafton on 17th June. He appeared to be suffering and witness told him to discontinue, stating he would not undertake the responsibility of permitting him to go down again. The reason given for going to the hotel on the day named was to ring up a doctor, as one of the defendants was sick.
