Ho was a bachelor nod in hiswill ho loft about Twenty Thousand Dollars in legacies to friends and servants and the descendants of slaves formerly owned by his family. He loft the residue of his estate to St, John’s Episcopal Church at Kew Bo* ehelle and directed that hive Thousand Dollars of it be held in trust by the church, and the income of the Hve Thousand Dollars bo distributedamong the poor of the parish. Dyck-man Odell, a grand-nophow of tho deceased, contested tho will, and Judge Nolson waB his attorney. It was admitted ou the trial by tho executor’s attornoy, Mr, IVm, H- Sage, that said legaoy of Tivo thousand Dollars was void because tho interest of it is left to an indefinite and uacor-tain class of persons. Mr. Odell claimed that this void legaoy and several of tlio legacies that wore left to former slaves, who diod boforo Mr. Bonnet died, all went to the next of kin whom Mr. Ocloll represented and did not pass to tho church, who was the residuary legatee. This view was opposed by the Executor and Surrogate Coffin has juat rendered his decision holding that tho lapsed and void legacies go to tho church, who lm3 thus fallen heir to a largo sum of money.
