Notice is hereby given that the viewers appointed by the board of commissioners of the counties of Elkhart and LaGraugo ut their November term 1903, on a petition of Noah Whirled*?!* et al. for apublic ditch, havo filed their report iu the auditor’s office-of each of said counties.Said petition and report will be hoard on tho 3rd day of February 3904, the saihe’being the 3rd day of the regularFebruary term of said commissioners court of said counties. Said ditch begins at a point 45 rods cast of a point 70 rods south of the center corner ofsection one (1) township thirty six (35)north, range seven . (7) cast* Elkhart County, Indiana, and runs in a gen oral easterly and northernly direct ion, to a point thirty-five (35) rods east and thirty-seven (37) rods north of northeast corner of section six (5) township thirty-six (35) north range seven (7) east, Elkhart County, Indiana anil in Rowe ditch, Eden township, LaGrange County, Indiana.Lateral A terminating at a point thirty six (35) feet below stake twenty-six (35) of main line and from said point extending north and west to stake •‘0” the beginning.Lateral C commenceing two hundred and seventy two (272) feet north and twenty-eight (28) feot west of the southwest comer of section six ((V),township thirty-six (35) north, range eight (8) east and from said point extending south and east and terminating at stake forty-three (43) mam Hue of said ditch.This ditch effects the lands owned or occupied by the following named parlies: Noah Whirledge, Clark Elliott, Clinton township benifit of public road, “Sarah E. SUowaiter, estate,” Samuel Thomas, John Thomas, Valentino T. Yoder, John Q. Sboup, Thomas and Alecta Shoup, Amos Cobbutu, Mary E. I)unu, “ThomasShort, estate,” Patrick Pence, Henry Swinehart, Susan Eld-redge, Henry Prough, Eden township benefit of public roau, Mrs. J. B. Smith, Joliu Kauffman and Milton Shoup.Each and all parties named in the above report desiring to show can.se why the said report should not be granted are notified to appear in accordance with the above named date and place.The Viewers of Elkhart Co. reported favorable for the establishing uf the ditch and the viewers of LaGrange Co. reported unfavorable.
