The following new suits have been filed with the circuit clerk since last week: New Union Lumber Company vs. Clara Eppel and Edward Eppel et al., to foreclose material men’s bin. Clarence Bonham vs. American Miners Accident Association, an in surance policy. Etta Calvin vs. Jennie Beasley, petition for guardian. William L. Slinkard vs. Alvie Flynn, foreclosure of mortgage. Marion Young, of Stockton town ship, has filed suit for separation from Laura Young. In his com plaint he alleges that they were married in May, 1901, and separated January 8, 1912, at which time she was guilty of adultery, and which of fense she had been guilty of divers and numerous other times during their married life, and that she was quarrelsome and at times called him vile names. He asks the court to grant divorce and custody of their child, May, eight years old. Daniel G. Klinger, a prominent Fairplay township citizen, has brought suit for damages against the Illinois Central Railroad com pany for $100.00, alleging that during the past summer the grass along the right-of-way burned and totally destroyed a hay field of this plaintiff, and for which he asks damages to the amount specified. The following cases on the state docket have been disposed of since last week: Oscar Sims, of Bloomington, who was tried and convicted last week of of running a blind tiger in the hol low east of the old jail site last May, has filed a motion for a new trial. The case of Joseph Drugman, for bigamy, the defendant was placed on bond of $500, which was given, and defendant allowed his freedom till called for trial. Martin Norris, of Linton, who on the seventeenth day of the term, plead guilty of visiting a gaming house and his punishment taken under advisement by the court till Jan. 8, was brought before the court last week and given a fine of $5.00 and cost with J. N. Vaughn as security. The following cases on the civil docket have been disposed of since last week. The cases of the State of Indiana ex rel Ruby Bullock vs. Charles Joseph, and Anna Mullins vs. T. Myers, bastardy, have been stricken from the docket for the reason that defendants’ whereabouts are un known. Leave to re-instate is given by the court. In the damage case of John W. Dickey against the Evansville and Indianapolis Railroad Company the plaintiff was awarded $317.50 dam ages. The quiet title proceeding of Mat thew Kelley and Marie H. Kelley vs. Norton, Reed Stone Company et al., which was venued from Daviess county, has been found in favor of plaintiffs. Everett Nickless vs. Vandalia Coal Co., damages; trial by jury and judgment for defendants. Harry Shearn vs. Shirley Hill Coal Co., damages; compromised and dismissed. The case of Albert F. Kivits et al., vs. C. L. Likens et al., has been vented to Lawrence county. The divorce proceedings of Eva M. Edwards against Roy Edwards, which was set for trial on the second day of the term, was dismissed on account of parties failing to appear. Lora Baker vs. Freeland Gee, bastardy, compromised and dismis sed by the plaintiff paying 50 cents cash and giving note for $50.00. The foreclosure of Douglas Payne against the Indiana Steel and Iron Company, the Linton Rolling Mill Company and the Linton Trust Company as receivers of the Indiana Steel and Iron Co., were found in favor of plaintiff in the sum of $236. 22 and foreclosure of lien. Mollie Reed was granted a divorce from Floyd J. Reed. The Farmers and Mechanics Building and Loan Association was given a judgment of $190.48 against W. W. Shearin et al. William Lehman was given a judg ment of $139.20 against Thos. Crab tree on note. Henry C. Holley was granted a divorce from Stella Holley. The injunction proceedings of Allie L. Ewing against Edward G. Smith, James C. Mitchell, John J. Weist, Sherman Goss and Wm. Steel has been compromised as to Steel and Goss in that they are al lowed sixty days to remove all tim ber already cut on premises, but a perpetual injunction against all par ties as to standing timber and judgment of $886.80 and foreclosure of mortgage against defendants Mitchell and Weist. The injunction proceedings of Alfonzo F. Wilson against Mark C. Boswick and Charles Jackson, are set for hearing in court today. The trial of Lewis McKnight, of Jasonville, for the murder of An drew Maroush, near that place, some time ago, was begun Monday. All of the fournoon was taken up with the selection of a jury, but most of the regular panel was used. The case went to the jury at two o’clock Wednesday afternoon, after two and one-half days of a hard fought legal battle. It will be re membered that McKnight and an other man, who is being held as an accessory, met Maroush and two of his fellow-countrymen at the out skirts of Jasonville. Whether there was any provocation or not, Mar oush was shot dead. In his testi mony before the court McKnight did not deny the shooting, but claimed self-defense, because, as he stated, he thought Maroush made a move to draw a weapon. The attorney for the defendant, McKnight, was Claude E. Gregg, of Bloomfield, as sisted by Collins Jeffries, of Linton, while Prosecutor James M. Hudson, for the state, was as sisted by D. W. McIntosh, of Linton. After deliberating on a verdict for nineteen hours, and had balloted a number of times, the jury returned a verdict of manslaughter, which means from two to twenty-one years ,in the penitentiary. John A. Cravens, as trustee, has filed his final report in the estate of John French, ex parte, which report has been accepted by the court and trustee discharged. David Garey has been appointed guardian of Susan Stewart, widow of the late John Stewart. James A. Jones has been admitted to practice at the Bloomfield bar and has formed a partnership with Wm. L. Shnkerd, James G. Hert and Franklin Ram sey have been appointed jury com missioners for 1912. Martin L. Combs, admr. of the estate of Geo. R. Axtell with will annexed, has filed his report of sale, which was approved by the court.
