LEGAL NOTICE.To all whom it may concern :— Notice in hereby given that the undersigned, Nelson King, \VU1 is Foster, Urias Thomas, David Johnson and t William Trail, as Trustees of The First Colored Baptist Cuureh, of Homo City, Hamilton County, Ohio, did, on the 13th ui*v of December, A. D. 1839 file in the Court of Common Pleas of said Hamilton County, their certain petition in cause numbered, on the dockets of said Court, 85628, which said petition, among other things, sets forth that the said The First Colored Baptist Church, of Home City, Hamilton County, Ohio, is a religious sovietv, butnot incorporated, organized for tha v orship of God, and located at said Home City; that said religious society is the owner in fee pimple of a lot of land, more fully, hereinafter described ; that the legal title to said lot of land, is vested in the said Xeison King, Willis Foster and Urias Thomas, as trustees, for the use and benefit of said religious society, and of the members thereof; that said society has begun the erection on said lot of land, of a church and house of worship, for the use and benefit of said society and the members thereof; that all of the available cash and funds of said so-. ciety have been expended in building the 3r ! foundation walls and substructure of said church and house of worship ; and that, in t order, to build the superstructure, or house ’s of worship proper, it will be necessary to 11 borrow money, and for the said trustees, is j Nelson King, Willis Foster, and Urias bo I Thomas to mortgage and incumber the ih • hereinbefore mentioned lot of land, ar d ol which is more fully described as follows;--“Beginning at a pointin said Home City, where the south line of Shady avenue in said city intersects with the east line of Lafayette street in said city; thence running southwardly, along the east line of said l*afayette street, forty-five (45r) feet; thence running eastwardlv. at right angle5’ to sai l Lafayette street, fifty-eight (58) feet, six t C) inche*, to the west line of a lot of ground formerly owned by John Van Amringe but now owned by Jacques Mattai; thence running northwardiy, along the line of said Van Amringo and Mattai, and para-lel to the said east line of Lafayette street forty-five (45; feet, to the south line of j said ShadV aver.ue; thence running west— wurdly along the south line of said Shady avenue, fifty-eight feet, (58) six (6) inches, to the place of beginning; the property herein described being forty-five (45) feet oft* the nortn end of lot numbered one hundred and eight (108; of the Cincinnati Building Association Purchase of Home City, Hamilton County, Ohio, as recorded in plat of said town in Deed Book 148, pages 232 and 233 of the recorder's office of said county; and being the same !r- property conveyed to said Nelson King, Willis Foster, and Urias Thomas, as Trustees, by Aaron Dudley by deed dated March 22d, 1889, and recorded in Deed-book No'. 669, page 172 of said Hamilton County records.’’Said petition further sets forth that the cost and expense of said superstructure or house of worship proper, is not to exceid one thousand (1000) dollars; that said religious society, as a congregation, and the members thereof, individually, desire ahd are anxious to have the same constructed and erected, and desire and are willing and consenting that said lot of land hereinbefore described should be incumbered and mortgaged for a sum sufficient to meet the cost and expense of the same; and that the board of trustees of said religious society, by resolution duly passed and approved, have authorized the negotiation of a loan of one-thou«and (1000) dollars, and of the securing of the same by incumbrance or mortgage on the lot of land hereinbefore described, in the manner and formetetidleatatvernounull©, Iisreanehe’11b.]
