CITATION BY PUBLICATION THE STATE OF TEXAS TO: The defendants hereinafter nam ed, other than J. W. Frazer, County Clerk, GREETING: You are commanded to appear by filing a written answer to the plaintiff's petition at or before 10 o'clock A. M. of the first Monday after the expiration of 42 days from the date of issuance of this Citation, the same being Monday the 1st day of February, A. D., 1954, at or before 10 o'clock A. M., before the Honorable 83rd District Court of Brewster Coun ty, at the Court House in Alpine, Brewster County, Texas. Said plaintiff's petition was filed on the 12 day of November, 1953. The file number of said suit being No. 2810. The names of the parties in said suit are: The State of Texas as plaintiff, and J. W. Frazer, Coun ty Clerk, et al, as defendants. The nature of said suit being sub stantially as follows, to wit. About 1942, the State of Texas filed certain condemnation suits in the County Court of Brewster County, Texas, to condemn lands for what is now Big Bend Nation al Park. Default judgment was rendered in certain of said causes wherein the defendants were cited by publication, and the compensa tion awards in favor of such claim ants to the condemned lands were paid into the peggy dne the court to the defendant unly Clerk. Said clerk still holds $27,567.22 in said account to the credit of the defaulting defendants. This suit is to judicially declare the escheat of such funds.
