Legal Department.QITCH NOTICE.In the mtter of ditch petition of Noah Whiriedge et 1. for the location of a public ditch in Elkhart and LaGrauge Counties, State of Indiana. Notice is hereby given that the viewers appointed by the board of commissioners of the counties of Elkhart and LaGrange at their November term 1903, on a petition of Noah Whirledpe et al. for a public ditch, have filed their report in the auditor’s office of each of said counties.Said petition and report will be heard onthollrd day of February 1901, tub same being the ;ird day of the regular February term of said commissioners court of said counties, Said ditch begins at a point 4j rods east of a point 70 rods south of the center corner of section one (1) township thirty - six (30) north, range seven (7) east, Elkhart County, Indiana, and runs in agenoral easterly and northernly direction, to a point thirty-five (35) rods east and thirty-seven (37) rods north of north-cast corner of section six (0) township thirty-six (3f») north range,, seven (?) east, Elkhart County, Indiana and in Rowe ditch, Eden township, LnGrange County, Indiana,Lateral A terminating at a point thirty-six (30) feet below stake twenty-six (20) of main line and from said point extending north and west to stake “O” the beginning.Lai era! C comnienr-ning two hundred mid seventy-two (272) feet north and twenty-eight (28) feet west of tko southwest corner of section six (0), township thirty-six (30) north, rnngo eight (8) east and from said point extending south and east mid terminating at stake forty-three (43) mam line of said ditch.This ditch effects the lands owned or occupied by the following named parries; NoaIi Whirledge, Clark Elliott, Clinton lownship benifit of public road, ‘‘Sarah E. S ho waiter, estate,1 ? Samuel Thomas, John Thomas, Valentino T. Yoder, John Q. Shonp, Thomas and Alecta Shonp, Amos Cobbum, Mary E. Dunn, “ThomasShort,*estate,” Patrick Pence, Henry Swinelinrt, Susan Eld-rcdge, Henry Prough, Eden township benefit of public road. Mrs. J. B. Smith, John Kauffman and Milton Shonp.Each and all parties named in the j above report desiring to show cause I why the said report should not bo grant-! ed arc notified to appear in accordance with the above named date and place. IThe Vicwors of Elkhart Co. reported fa\*orablo for the establishing of the, ditch and the viewers of LaGrange Co. reported unfavorable. V. D. Weaver.
