Three Judges Dissent From the Prevailing Opinion in the Court of Appeals. ALBANY, Jan. 13.-The Court of Ap peals by a divided court has decided that the State law prohibiting the em ployment of bakers more than ten hours a day or sixty hours a week iy Constitu tional, Chief Judge Parker writes the prevail ing opinion, in which Judges Gray, Vann and Haight concur, Judges Gray and Vann also writing opinions. Judges O'Brien, Bartlett and Martin dissent. Judge O’Brien writing a dissenting opin ion. The decision is rendered in the case of Joseph Lochner, an employing baker of Utica, who was prosecuted for a violation of the law, convicted and fined $50 and costs. His case was made a test case. Judge O'Brien’s dissent is based upon the ground that the law violates the per sonal rights of contract.
