Developer will request new hearingBy SHAWN CHURCHOf The News-ReviewJim Beamer, who wants to build a residential shopping center in west Roseburg, will ask the City Council Monday to rehear arguments for a proposed zone change.Beamer said Thursday afternoon he will ask the council to reconsider denial of his request to change the land-use designation on the 8.7-acre site — from high density residential to commercial — before appealing to the state Land Use Boa’-d of Appeals.“I just know a shopping centerwill eventually be there,” he said. ‘‘It’s not feasible for apartments.”Beamer said he bought the property for $175,000, just days after the council voted 5-3 Dec. 8 to uphold the Planning Commission’s denial of the zone change.“I will just continue to take this as far as I have to take it,” he said. “I have to. I have so much invested in it.”Darryl Johnson, Beamer’s Roseburg attorney, said the request for a second hearing was made because he believed the council acted improperly when it allowed city staffand a planning commission member to argue against the zone change during its review.Johnson said the council’s review should have consisted of only arguments from the council and the applicant. Specifically, he said, Planning Commission Vice Chairman Daniel Robertson, City Manager Bob Barbee and Community Development Director Chuck Rhodaback were permitted to argue the issue.“They made arguments against the project,” he said. “They were the most vocal of anyone there.”Johnson said the council also “erroneously” applied criteria for public need.He said Beamer should not be required to show need for a new shopping center in the entire city. The zone change request should be decided based on need in west Roseburg, he said.Beamer’s proposed $3 million shopping center would be anchored by a 30,000-square-foot grocery store occupied by Dee’s Market,(See DEVELOPER, page 3)
