St. Paul, Jan. 8.—.——A plea for clemency in behalf of Elster Me Wha, 28-year-old Arkansas resident who was convicted in Freeborn county of murder and given a life term in Stillwater prison, was made before the state pardon board to day. Rev. Claude L. Jones of Amity, Ark., the prisoner's home town, and Floyd ¥. Nichols of Albert Lea ask ed the board to commute the sen tence Mc Wha peered guilty on Oct. 29, 1938, to a first degree murder charge for the shooting four times of a village marshal who had struck him while forcing him to leave a poolroom. His application for a commuta tion claims he was drunk and “tem porarily insane” and that it “hap pened on the spur of the moment.” William P. Sturtz, Freeborn county attorney, wrote a letter opposing clemency, asserting McWha had been drinking “beer” and that the offense was “clearly premeditated.” The board took the case under advisement
