ATTORNEY LYNCH, TRUSTEE. Not a Surprise to the Merchants of this City. Yesterday morning a writing was admitted to record in City Clerk Gray’s office, assigning to Attorney M. M. Lynch, the mercantile busi ness conducted by E. E. Herring in the Faulkner building on South Main street. The assignment in cludes all the stock of goods, wares, and merchandise now in the store room and consists of dry goods, boots, shoes, rubbers, gentlemen’s furnishing goods, groceries, con fectioneries, various other articles of merchandise, store fixtures, such as stores, show cases, scales, etc., and is valued at $5,000. By provisions of the deed Mr. Lynch is to take immediate control and sell the contents of the store for cash at public auction or priv ate sale, or, part by private and part by public sale. He will em ploy the clerks and salesmen he thinks necessary and is to pay the expenses of running the store out of the proceeds of sales and also is to pay out of the receipts of these sales the costs attendant upon this execution, together with the com mission of 5 per cent, allowed him as trustee. After satisfying these claims the trustee is to, devote the remainder of the proceeds to. ‘ o of outstanding obligation’, in full if possible and if not, then the re ceipts are to be divided equally among the creditors and each will receive a percentage. These liabil ities of the firm amount to $7,285. With two exceptions the creditors are Baltimore firms and the debts are all open accounts, viz: Daniel Miller Co., Baltimore, $3,745.45; Frank Adler, Balti more, $875; S. Haines Co., Balti more, $6.30; John Turnbull, Jr. Co., Baltimore, $10.25; George Blome Son, Baltimore, $191.21; M. W. Wolf Co., Baltimore. D. T. Buzby Co., Baltimore, $18.24; McCormick Co., Balti more, $920; Sons Brothers, Balti $32.40; Reyman, Doyle Co., Bal timore, $9; Tregalis, Hertel Co. Baltimore, $55; The Pittsburg Dry Goods Co., Pittsburg, $272.18; W. E. Van Sant, Baltimore, $16. Mr. Herring came here about two years ago from Martinsburg, of which city he is a native. He had conducted similar enterprises in Seesee Brunswick and his arrival in this city was a sign for a spirited rivalry between him self and local merchants. The ri valry proceeded with vigor, and resulted in the price of food stuffs. Hr. Her ring maintained the competition for “some time and display ed an energy that bid fair to bring him out of the mercantile strife successful. The close of his business career was predicted weekly by rival merchants until it seemed that he had come to stay. He advertised extensively at first, but gradually curtailed this por tion of his business proceedings and subsequently relinquished the Eichelberger building on Piccadilly street. In the declining days of his business however he did not lose his pertinacity and courage, but fought the fight to a hard fin ish in an aggressive manner. The store in the Faulkner build ing is now closed while an inven tory -is-in- progress, but will soon be reopened with Mr. Wm. Conway as manager and Mr. Burton Tur ner, chief clerk. If the goods are not sold at public auction or as a whole the young lady clerks will be retained. They save Misses Emily Connor and Annie Grim,
