ALBERT H. HERR FILES SUIT, AGAINST CHARLES G_ AND cM. RUAXL Alleging that he was defrauded in, a feat in which he thought he was iruesterring Lima property and ing a $2450 note for stock in the “Bankers’ Insurance Company,” which is organized and doing busi ness under the laws of ate of lilinois Albert A. Herr today brought suit in common pleas coure against Charles ©. Truax and Clarence 4M. Truax. Herr states to his petition that Clarence ‘[ruax represented himself as being empowered to do business for the insurance company and that he (Herr) gave to Truax a note to $2,500 and also a deed for two lots in Collinwood addition to Lima. In exchange for 16 shares of stock in the company, Merr alleges that his stock wasn’t accepted by the insur ance company, and that the campany notified Claronace Truax to reconvey the property to Herr and to return the name to him. This, Herr avers, Truax has refused to do. ‘The plaintiff avers further that the thought he was making the deed to Clarence Truax, but that the latter misrepresented affaires In such a man ner that the property was deeded to one Lillian. Ridenour, from whom, Herr says, Truax received valuable consideration. A short time Isier, Herr avers, Lilian Ridenourr , died and her husband, Samuel B. Riden our,, was left sole heir. Samuel Rid enour, Herr states, deeded the prop erty to Clarence “Truax's brother, Charles C. Truax, receiving valuzble consideration therefor, Herr now asks the court ‘to com pel Charles Truax to recenter theer property to hint and Clarensd Truax to return the F215kd note to his pos session.
