JrplIE complainants filed theirbill of complaint, stating that at the August Term of the Supreme Court of O-hio, holdcn within and for Huron county, they recovered a Judgment against said Joseph Akers and one Luther Harris, impleaded with others, for $276 21 including damages and coats which is $uc to complainants, and that defendants have no property whcreout to make the same : That said Joseph was possessed of a certain tract of land in the township of Florence in said county, to wit:—fifty-one a-cres of land otV the north part of I,ot number fifty-two, which on the 11th of April, IN,*)?, he conveyed to Daniel Ross, by deed of that date, for $1000, the greater part of which was still due and unpaid at the time of the exhibiting of said hill:— That said Richard and Hannah Akers also conveyed certain other lands to said Ross on the same day for $700, a part of which was then paid by said Ross, all of whom arc made defendants:—that on the same 11th day of April, 1n;)7, said Ross executed a mortgage on both tracts of land to pay his note given for the consideration of said tracts then unpaid, to Hannah, the wife of said Richard, for the sum of $1659 50, due on the lirst day of November, 1*57, with interest:—that said note belongs in equity to said Richard and Joseph, and that there is due from said Ross to said Joseph thereon a sufti-cient sum to satisfy said Judgment:— That said Ross had notice of the above facts at the date of the purchase,—and that the suit was pending against said Joseph when the same was made, in which said Judgment was rendered: and that the said note and mortgage was so taken in the name of said Hannah to protect it from the claim of orators. JSaid hill prays that said land be subjected to the payment ofthe complainants* Judgment, and that said Ross pay the same out ofthe moneys due to said Joseph, and for further relief. And it appearing to said court that said Joseph, Richard and Hannah were not residents ofthe State of O* hio, it was thereupon ordered by said court, at the November Term, 1*57, that notice he given to said non-resident defendants of the substance and prayer of said hill.Notice is therefore hereby given to said defendants, that, unless they appear and plead, answer or demur to said hill within sixty days after the next Term thereof, the same will he taken as confessed.J).
