Your memoralist asserts that lie lias never taken up arms against the United States or the State of Kentucky, or given aid or comfort to those who are in rebellion against the Government. He asserts that he has violated no law, either State or national, which would deprive him of his liberty; and if he has, ho insists that, by the Constitution and laws of bis State, he is entitled to, and, by right, ought to have, a fair and impartial trial or investigation of his ca-e: and if the charges againstc*him are not established hv competent and• •satisfactory evidence, should he restored to his personal rights and liberty by the verdict of a jury of his country. He says that his State claims, and is entitled to. his allegiance so long as he remains a citizen thereof; for which he demands, and should receive, her protection from any wrongful act and, particularly, from illegal incarceration.He, therefore, respectfully petitions your konorable hod)', if not incompatible with your public duty, to interpose on his behalf. He asks that you, in your legislative capacity, inquire by what authority he was arrested and is now held in durance vile outside of the limits of his State; and that you either demand that he be immediately and unconditionally released from imprisonment, or be removed to Kentucky, and granted the constitutional privilege of a speedy trial in his own State, where he can confront his accusers and defend himself against any charge that is or may he made against him.It is hoped that this memorial will receive your earliest attention.Kespectfully,j!
