Released on bond pending their March 27 sentencing are Destin charter boat captain Richard Abraham Rosen, localreal estate broker Robert Essen Rew and David Benton Holmes, an antique curator.In addition to conspiracy charges, the three men each were found guilty last week on one county of aiding and abetting an attempt to import more than1,000 pounds of marijuana into the country, said a spokeswoman from the Fort Lauderdale officeof Federal Magistrate Norman Roettger.Rosen, operator of the Pescador III charter boat, also was found guilty of “knowingly and intentionally” using a telephone to facilitate the conspiracy to import the illegal substance.Rew was found guilty on a third charge—that being the actual importation of more than1,000 pounds of marijuana, thespokeswomen said.The trio each faces a 30-year sentence in federal prison and/01 a $30,000 fine for each of the two counts on which they were charged, according to Destin attorney Mark Frederick, who represents Holmes in the case.Rosen faces an additional four-year sentence on his count of using a telephone to facilitate theillegal activities, and Rew could receive a maximum 15-year penalty on the charge of actual importation.The three defendants stood trial in U.S. District Court in Fort Lauderdale from Feb. 6 through Feb. 15, according to the spokeswoman. After deliberating seven hours over a two-day period, a 12-member jury returned a guilty verdict on all countsas charged, she said.Frederick said because federal Drug Enforcement Administration (DEA) agents had destroyed the marijuana seized as evidence during the covert operation, tapes of telephone conversations were heavily relied upon as evidence.He said the tapess contained conversations with Edward Car-con iinued on Page 7A
