Sensational Development in Breathitt j * County Litigation.iLouisville. Ky., Feb. 8.—Quite the : most sensational development in the ; -litigation over the Breahitt county j' murders came out when the deposition 1 of Moses Feltner, a witness, who left !r Kentucky after having been subpoe- j •! naed as a witness in the damage suit j £ of Mrs. Abrelia Marcum against Judge j c Hargis and others for conspiracy in !c connection with the murder of James 11 B. Marcum, says a special from Win-! c Chester, Ky. Feltner s statement is to a the effect that attorney for the defense, v B. F. French, offered him $1,000 to i * leave Winchester without testifying, j 1 and that if he did not go, he would | * be hanged for the murder of Jesse j' Fields, some time ago, in Breathitt J ^ county. Feltner says he accepted the j c money, went to Cincinnati and turned t it over to his brother, Felix Feltner. Later he (Mose Feltner) was met in c Cincinnati by Mr. French and was told 1 to stay where he was, as warrants had t been issued for him in many counties 0 in Kentucky bordering on the Ohio 1 river. French told him, according to c Feltner’s deposition, that his bond had ( been vacated in the Fields murder case, * and that a warrant would be sent ta Cincinnati for him, but that he must 1 not come back to Kentucky without a requisition. But, Mr. French told me, the statement continues, that Gov. j Beckham had promised him (French) that this requisition would not be issued until after the Marcum-Hargis cases had been settled. French then t gave him more money, and after spend. t ing some time in various Ohio towns t and Indianapolis, Feltner says he con- t eluded to return to Kentucky and give ^ himself up as a witness. cLexington, Ky., Feb. 9.—MosesFeltner will, through Winchester at- ^torneys, appeal to the governor for jtroops to guard him. when he is ta- j tken to Jackson on the 20th to be tried i (on the charge of murdering Jesse i fFields. As a result of startling evi-1 rdence given in his deposition at Win-1 ^Chester he fears assassination. ! __DEPOSITION OF SAM FIELD. j \He Is One of the Witnesses Who It Is * Alleged Were Enticed Away. | aWinchester, Ky., Feb. 10.—The dep- j \ osition of Sam Fields was taken. He j r was one of the witnesses who it is i „ alleged were enticed away from here i j during the Marcum-Hargis trial and! r is now under arrest for contempt of j court. He corroborated Mose Feltner ( in that B. F. French paid them money, and that all the expenses were paid ; l by Feltner. Sheriff McCord received from the circuit clerk of Breathitt 1 county a warrant of arrest for Mose i Feltner. It was issued at the request; f of S. H. Hurst, who is his bondsman j e for $5,000, for his appearance at Jack- j p son to be tried for the killing of Jesse j d Fields, and Hurst desired to be releas-. t ed from this bond. j \Circuit Judge Benton has stated j that so long as the prisoners are in | f the custody of the Clark county offi- f cers they shall not be taken to Jack- c son.
