WASHINGTON, (U.P) — The Supreme Court today refused to reconsider its decision that the Army's evacuation of Japanese from the west coast in 1942 was a togal warting action. The court denied a petition of Fred ‘Toyosaburo Korematsu, Japanese-American from San Leandro, who asked the court to reconsider a Dev. 18 decision upon holding his conviction for fail re to report for evacuation. Korematsu, given a five-year probationary sentence, contended the decision overlooked the fact that native-home Japanese had been shorn of citizenship rights, “i military control over clive ihauy ds to be unlimited” his petition 1, we might as well openly declare in favor of a mod ern police-state quaterned after ‘the ld Byxunting kiw or Visi sgothie curd!
