The plaintiff and those under whom it claims have been in un interrupted possession of certain real estate situated in said Bar Harbor for more than four years, to wn: from December 1, 1930, which said real estate is described as follows: A certain lot of parcel of land situated in said town of Bar Peter Rabe to Bangor Hydro- Electric Co., Mt. Desert. Alphonse C. Pasquale to Ban gor Hydro-Electric Co., Mt. ,Des ert. Edith Pearl Ferguson to Len ora E. Treat, Deer Isle. a Flora M. T. Mitford et al to United States of America, Bar Harbor, and L. A under the Wil]her comb, by deed dated Janus 1950, recorded in Hancock Re stry of Deeds, Vol. 782, Page 2. The source of the plaintiff's title to said real estate is as fol lows: Warranty deed from nore Registry of Deeds, Vol. 605, Page 536; warranty deed from Margaret L. Higgins to G. Arthur Liscomb, dated June 17, 1946, recorded in said Registry, Vol. 706, Page 424; trustee’s deed from Gerard L. Aus tin, trustee under the will of G. Arthur Liscomb, deceased testate, to the plaintiff, Morrison Dairies, Incorporated, dated January 23, 1950, recorded in said Registry, Vol. 782, Page 459, which said last mentioned deed was confirmed by a decree of our Superior Court in Equity by a decree dated January 8, 1951, in the Equty proceedings, Morrison Dairies Incorporated vs. Gerard L. Austin as trustee under the will of G. Arthur Liscomb, de ceased, et als, ir the Superior Court in Equity for the said County of Hancock, as by the re cord thereof will appear; the plain tiff claims title to the premises described in Paragzraph 1 hereof through the above source, and, Also, open, notorious, adverse, continuous and exclusive posses sion of all of the premises des cribed in Paragraph 1 by the plaintiff and those under whom it claims, claiming all of the time to own the same in fee simple, for more than twenty years prior to the date hereof, to wit, from De cember 1, 1930, to this date. 3. Said Margaret L. Higgins executed a mortgage to said Sarah A. Hazen, then of Haverhill, in the County of Essex and Common wealth of Massachusetts, dated De cember 1, 1926, recorded in said Registry, Vol. 606, Page 383, con ditioned to pay three certain prom issory notes, one in one year, one in two years and one in three years after date thereof, and to pay cer tain other notes and obligations therein described, all due before December 1, 1930, which said mortgage was assigned by the said Sarah A. Hazen to the First Na tional Bank of Bar Harbor by deed of assignment dated October 23, 1930, recorded in said Regis try, Vol. 645, Page 174. 4. That said mortgage has been paid but the fact of payment can not be established without the production of evidence and that said mortgage, although paid, is undischarged of record and can be a cloud on the plaintiff’s title. 5. That said Sarah A. Hazen is now dead. 6. The plaintiff alleges that the defendants, known, unknown, or unascertained, claiming by, through or under said Sarah A. Hazen or otherwise claim or may claim some right, title, interest or estate in the real estate above des criied and that their claims can not be met by the plaintiff without the production of evidence and
