Bodey in common pleas court Saturday. The stock sold for $38,018. Clarence Hess, sole heir of Anna Seitz, lately deceased widow of Seitz, claims the surplus. He says that the profit from the sale of the stock was increment to the Income which was devised to Mrs. Seitz, since the sale was made in her life time, though not paid in cash, due to lawsuits, until her death. Ten nieces and nephews of Frank Seitz, residuary legatees, claim it is part of the capital estate and hot income and thus belongs to them. The Commercial Banking Trust Co. filed an application as executor of the Frank Seitz estate, asking the court to rule. Hears, filed a cross petition. Judge . B. FILE DAMAGE CLAIM Ruel Flint, administrator of the estate’ of Albert Flint, filed action for 225,000 damages for the death of Flint, in common pleas court Sat urday. Virgil Squire of Defiance, is de fendant. Charges are of alleged careless and negligent operation of the auto which is said to have struck Fiint as he rode a bicycle along Cleve landrd on Feb. 19, 1680. Flint was so badly injured that he died in 20 minutes, the petition avers. It is charged that the alleged care lessness was in the operation of the car at a high and dangerous rate of speed, Survivors of Flint are listed as Ruel Flint, a son, and Ruth Cebull and Eunice Mainzer, daughters. Attorney John F. McCrystal filed the case. TWO GET LIQUOR FINE John Rucker and Henry Willams, both colored and of Homeville, were fined $300 and $500 and costs, re spectively, in municipal court Sat urday, by Judge Minor, on charges of possessing liquor. Merriam on charges for having stolen an auto belonging to Fred Dahl, pleaded guilty and was bound over to the grand jury in $1,000 bail in this case and In $1,000 on charges of having attempt ed to rob Dahs. Zvosec was returned from Louis ville, Ky. Friday. It was charged that he and his brother left to mar ket three pigs for Dahs and return ed, demanded money and, upon failing to get it drove off in the Dahs car. SETTLE DAMAGE SUIT The $25,000 damage action of Herman Winkles against Rolland Brand, was settled and dismissed in common pleas court Saturday.
