At different times during the past two or three weeks a commision consisting of Myron H. Peck of Ba tavia, Wm. Y. Robinson of Nunda, and E. Kuichling of Rochester has been hearing a case of considerable importance between the Erie and the Lackawanna Railroad Compan ies at Mt Morag and have cecided in favor of the latter Company. There were several prominent law yers engaged in the case, among them being John.G. Milburn of the firm of Sprague, Milburn, Sprague of Buffalo and General James Wood of Geneseo for the Erie, and the Hon. J. Maguire of Elmira and Charles J. Bissell of Dansville for the Lackawanna,together with W. A. Sutherland of Mt. Morris for the land owners interested. Then he applied for the appointment of com missioners to examine the proposed route of the Lackawanna in Living ston County. Proceedings were in stituted to effect an alternative route for the Lackawanna of about two and a quarter miles, embracing within its limits a point of crossing of the Avon, Genesee Mt. Morris Railroad running at right angles thereto. The commission affirmed the originally proposed route, which, according to the map and profile filed, crosses the last- mentioned road at grade.
