M. of the first Monday after the expiration of 42 days from the date of issuance of this Citation, the same being Monday the 22 day of January, A. D., 1945, at or before 10 II I o’clock A. M., before the Honor-f I able District Court of Jones County, at the Court House in Anson, Texas.Said plaintiff's petition was filed on the 9th day of December, 1944. The file number of said suit being No. 7414. The names of the parties in said suit are: A. J. Smith, Jr., as Plaintiff, and Henry Hager, Andrew Hager. Vina Peters and husband, E. E. Peters, Leonard L. Hager, C. P. Hager, Evelyn Broley and husband, L. B. Broely, Gertrude McCada, W, D. McCada, Leona Mae McCada, a minor, Rita McCada, a minor, Eddie May Gates and husband, Frank Gates, Clifford Hager, Clarence Hager, J. B. Hager, Dorothy Burrus and husband. Tony Burrus, Ruth Henry, a widow, Verna Carl Hager and Gladys Marie Duhon and husband, Stephen Duhon as Defendant.The nature of said suit being substantially as follows, to wit: Suit for partition of real estate, described as the North East one-fourth of Section No. 29, Deaf Dumb Asylum lands in Jones County, Texas, of the estimated value of $4,-500.00, it being alleged that plaintiff is the owner of an undivided 41-48 interest therein; that the defendants, Henry Hager, Andrew Hager, Vina Peters, Leonard L. Hager and C. P. Hager, each own an undivided 1-48 interest therein; that defendants, Eddie May Gates, Clifford Hager, Clarence Hager,J; B. Hager, Dorothy Burrus, Ruth Henry, Verna Carl Hager and Gladys Marie Duhon, each own an undivided 1-384 interest therein ; and that the defendants/Evelyn Broley, Gertrude McCada, W. D. McCada, Leoona Mae McCada and Rita McCada, each own an undivided 1-240 interest therein, and plaintiff asking for the partition of said real estate, or in the alternative, the sale thereof and the partition of the I proceods from said sale, j Issued this the ,9th day of December, 1944.
