Judge Boyd in the United States Court for the Western District of North Carolina has just rendered an important decision on the celebratedwhite slave case in which Joseph W. Napier and E. Charles Quaster were defendants. .Referring to the discussions whichtook place in Congress when the act was passed regarding such cases, the judge held that the act was not applicable to such a case as was beforehim, and he therefore directed the jury to return a verdict of not guilty. He held that the United States Congress could not directly or indirectly pass a law that would make punishable offenses cognizable under the police power of the State.He did not hold the act of Congress to be unconstitutional, saying it was a wholesome law, but that this particular case did not fall within the purview of the act.The well prepared brief in the case submitted by Mr. John W. Hutchinson, one of the youngest members of the Charlotte bar was highly complimented by Judge Boyd.
