(Before the Chief Justice and Mr. Justice Little.) Saturday the court was occupied in the hearing of a petition from David Chafe, on the Bay Bulls road, one of the execu tors of the will of Jacob Chafe, late of the Goulds, deceased. The petition set forth that Jacob Chafe died about 8 years ago, having first made a will, which, owing to some irregularity in it, was not proven, but that all the legatees under the said will had at the time assented, by deed, to the terms of the will. That in the said will a clause was set forth that during the life-time of the widow of said Jacob Chafe, her children and grandchildren mentioned in the will should stand by her. That the said widow died last February, and that the petitioner, David Chafe, who, under the deed of assent, was appointed administrator, now comes in and asks the direction of the court as such ad ministrator, as the distribution is now objected to by some of the parties who signed the deed above referred to. The court heard the following members of the bar in reference to the claims of the various lega tees whom they represent: Mr. Johnson for petitioner and other lega tees; Mr. McNeily appeared for Am brose,Chafe and sons, and Thomas and William Chafe and wife, and Mrs. Washington Winsor; Mr. Morrison ap peared for George Ruby and wife, and Aaron Chafe and wife; Mr. Morris ap peared for Sarah Brennock, grand daughter of Jacob Chafe; Sir William Whiteway appeared for other legatees under the will. Mr. McNeily, on the part of the dissenting parties,asked to have a bill in equity filed, setting aside the will and the deed referred to. The cause looks, from the company it is in, as if it was going to be fruitful of liti gation. The court gave no decision now reserved its judgment for a future day.
