Ordered to leave.—Major Smith, who has just been relesacd from a term of imprisonment of ten years in the Penitentiary, and who has been emancipated by Ilezekiah K. White of Goochland, was informed by the Mayor yesterday morning that he had no right to remain in the Commonwealth, He promised he would depart as soon as he could procure his papers from Goochland county.Too Much Negro.—Richard Bradby, a descendant of the Pamunkey Indians, wlio was arrested some days ago for being drunk anl disorderly, and com= mitted for want of a register, was brought up again yesterday morning.His counsel, Mr. Crane, entered into an argument to prove him a descendant of the Indians, and entitled to all privileges and immunities grant® ed to the tribe under the State law; and introduced Dr. Power as a witness, who testified to th8 genuineness of the following paper, which was found in Bradby’s’possession :—We, subscribers, Trustees for the Pamunkey tribe of Indians, hereby certify that the bearer, Richard Bradby, of a bright copper complexion, dark hair and eyes, with two scars one above and the other 011 the eyebrow on the left eye, about five feet eight inches in height, and aged twenty years, to be one of this tribe and is thereby entitled to all the privileges and immunities appertaining. LIPSCOMB,Trustees.The Mayor said that he was hound to treat him as a free negro, unless he could prove that he had less than one quarter negro blood in him, and contended that there was no law authorizing these Trustees to say who was and who was not a negro. Therefore he was compelled to hold to his original decision, and had him committed for want of a register.Mr. Crane then made application for a writ of habeas corpus to have Bradby brought before Judge Meredith.
