Those gentlemen, through Walter Dt»np-gre, their attorney and one of the leaders of the movement to lynch O’Malley, hunted up O'Malley's record and embodied it in their answer. In view of the.fact that later, and upon the very eve of the trial of the case, which whs to be defended with vigor, O'Malley voluntarily discontinued the suit, it must be taken for granted that Messrs. Hearsay and Dupre's answer was absolutely correct.'1 tie anawor said that O’Malley served a term in jail at Clevelaud, Ohio, for having a stolen watch in his possession, and also his arrest on two occasions io Cleveland for larcopcy, one of the charges concerning thf stealing of scrap iron from the shores of Lake Erie. The an ewer recounted O’Malloys record in New Orleans and embodied a list of the chargee and indictments on which O’Malley was jailed. These charges included bribery, subornation of perjury, perjury, blackmail, intimidation of witnesses, larceny, carrying concealed weapons, assault and battery, dangerous ana suspicious obaracter, gambling, tampering with 4jurys violating the revenue laws and biting. It also related the charges made by him against E. U. Schleidcr, the trial of the latter, his Requital, O’Malley’s indictment and the disappearance of the affidavit. The answer also contained reference to the special report of the grand jnrv in the Ford case,*denoi.ncing his double dealing and recommending that he be prohibited from coming about the court. The answer likewise related the details of how O’Malley secured employment as private detective for the Committee of Safety engaged in rooting oat gambling, and how be blackmailedan iut«rest in a negro gambling- houseon Franklin street from Wiliia Verneuille, at the same time causing the indictment of Juke Yaquclio who kept a gambling house next to Veneuille and who refused to be blackmailed.Since that suit O'Malley has served two terms in jail for carrying concealed weupona and has been engaged in swindling lotteries and blackmailing Sunday law violators. His record in the Criminal Court dunug Charlin Butler's term at* District Attorney is too recent and too well known to need repetition. He secured the indictment of Maurice J-.Hnrt and then attempted to btackmai! him out of $20,000 after bis quasi partner, Lionel Adams, had taken Bert's money. All of tlieue things are history and record, and they will be brought up in a very short time in the courts and O MaJley will have to admit tbeui if be goes on the stand daring the trial of E. 8. Whitaker for shooting him.Having disarmed of this part of the jail record of O’Malley, the assertion of the Progress to the effect that O'Malley gave charity to the drouth sufferers may be lookfed into. As a matter of fact, when the condition of the drouth sufferers tirat became known, the Daily Item, with other newspapers, applied for help. Flour and other provisions were contributed by the gamblers of New Orleans and s(?nt to the Item office. It is preeumed that O'Malley transmitted them, though there may be justifiable doubt on the subjectAfter that O'Malley organized a comedy company to give performances for the benefit of the drouth •offerers, The Item daily contained the (post glowing account of the overflowing houses which greeted tlie appearance of the comedy company. According to. the Daily Item it was a ^rand success. The Telegram or no one else has ever heard of any of the money thus obtained going to the drouth sufferers. If the company was the Buecees the Item claimed, then it made money and O'Malley kept it. If the company was a failure, then O'Malley lied.About this, though, there may be doubt concerning the fnnds. With reference to the case of the Widow Vittur there can be no doubt. Arthur Vittur, an engineer of the Spanish Fort road, was killed by the overturning of his engine, leaving a widow and eight children destitute. The Item at once proceeded to get up a subscription, and from time to time acknowledged the receipt of different sums, until the total was $147.Did Mrs. Vittur get this money or any part of it?The engineer's widow lives in the humblest kind of a home on Bienville street, between Broad and White. She ekca out a miserable existence selling wood and charcoal.
