Alien S. Olmsted, of Leroy, N, Y«, is the owner of the trade mark “Foot-Ease,” and he is the first individual who ever advertised a footSawder extensively over the country. The ecision in this case upholds his trade-mark and renders all parties liable who fraudulently attempt to profit by the extensive f,Foot-Eaae” advertising, in placing upon the market a spurious and similar appearing preparation, labeled and put up in envelopes and boxes like Foot-Ease, Similar suits will be brought against others who are now infringing on the Foot-Base trademark and common law rights.
