The t itleof the case is ‘‘State of Indiana vs. thePortsmouth Savings Bank. ‘‘The brio! ofAttorney general Hord recites in an exceedingly lucid style, the history and the law relating to such lands us those located in what was once the bed of Beaver Lake in Newton county. The lands in question amount to 560 acres and as the attorney-general states and abundantly proves by the highest legal authorities, are now held by the Portsmouth savings bank, not only contrary to law but in dciiance of all precedents. The laws relating to the public domain are familiar bo few persons and those which concern the swamp and overflowed lands of Indiana are quite as little understood, and the fact that any reputable party should claim the ownership of such lands without a shadow of a title, is indicative of u singular want of vigilance on the part of state officials charged with the duty of protecting the rights of the state. But our purpose is to recommend those of our readers who desire correct information relating to the rights of the state to swamp and overflowed landB within her boundaries, to procure a copy of tbe attorney-general’s brief. After a careful jterusal there will be found little remaining demanding study. And it should be said that while but 560 acres of land are involved in the cause now before the court, the fact is that the title to the entire bed of Beaver lake, 20,000 acres, is before the court, as also the bed lands of the other lakes within the state.
