THE SECOND COURT CASE Baby Has Been Object of Con tention in Two Actions in District Court. Baby Helen Genevieve Sullivan, orphaned daughter of Clarence Sulli van and Anna Utzig Sullivan, has at last found a permanent home and has ceased to be the object of con tention in habeas corpus actions in the Dubuque county district court. She is now with her grandparents on her father’s side, Mr. and Mrs. Timothy Sullivan. Clarence Sullivan, the father of the baby girl, died several months ago. Following his death, his young wife was stricken with pneumonia and was a patient at the hospital for weeks. Mr. and Mrs. Timothy Sullivan took her baby, because it had been the wish of their son when he died, that they watch over the child and care for her. The mother, even while she was seriously ill, objected to this ar rangement and instituted a habeas corpus action in court to get the baby. When the case was tried before Judge Kintzinger, Mrs. Sullivan had recov ered sufficiently to appear in court She was very weak, however, and had to be supported by two persons. _ The court ruled that the mother was entitled to have her child, but said that if events within a year showed the defendant's contention, that the mother was not a fit person to have the child because of her poor health, was based on good grounds a new faline might be made. But a short time passed after Mrs. Sullivan took the baby from her de ceased husband's parents, when she was stricken again and died. Mrs. Timothy Sullivan then sought the baby and instituted a habeas corpus proceeding to gain the custody of her. The matter was scheduled to come up for a hearing in court Wed nesday morning at 9 o'clock, but it then became known that Mr. and Mrs. John Uzzie had turned the child over to the Sullivans early in the week. This disposed of the case without any necessity of further procedure in court. Mr. and Mrs Sullivan are now the guardians of the child.
