Motion to vary a decree to refund to the heirs-at-law of Joseph Rowe, certain legacies paid by him as residuary legatee of his sister, Mary Rowe. The court ordered the decree to be modified so that all swims paid as legacies under the will of Mary Rowe by Seam be deducted from the fund bequeathed to the legatees respectively. KR. Fletcher and S. E. Sewall for the heirs of Joseph Rowe, P. W. Chandler, Emory Washburn and EF. C. Langdell for the retatees under the will of Mary. Surxmior Court—Criminal Session—Monday— before Russell, J. Charles Green was tried on a complaint charging him with stealing $4 in bank bills from the store of Jacy Melotosh. The jury returned a verdict of not guilty, and Green was discharged. David Hefferman was found guilty of the larceny of certain articles belonging to Jeremiah Harriman. Henry Sherwood alias Wm. Howard was found guilty of dealing a quantity of silverware from the 1ouse of Geo. B. Emerson. Under the name of Wm. Howard, the same indi vidual was convicted of attempted larceny from the person of a man unknown. Howard has served sen- Sents in the State Prison, Charlestown, and at Sing Sing. Wm. Powers and Remembrance K. Knowlton were convicted of the larceny of $65 oseneing to Gibbons Libber, keeper of the Exchange Hotel. Sentences.—Wm Howard, attempt to steal from the person, pleaded not guilty, one day solitary and one year in State Prison; the feame party, for larceny from the house of Geo. B. Emerson, five years in the State Prison. _ David Hefferman, larceny, fined $10 or two months in the House of Correction. John Hayes, assault with a pistol, fined $50 and re quired to give sureties for conduct. Wm. Powers and Remembrance K. Knowton, lar ceny, two years each in the House of Correction. tm.
