WITNESS IN MURDER CASE ARRESTED HEREJOE DAYEXPORT WANTED TO TESTIFY AGAINST BROTHER WHO KILLED FATHER.Joe Davenport, arrested In Walker township Wednesday, is wanted more as a witness in a murder case against his brother who is charged with killing their father, than on the misdemeanor charge upon which he was taken in custody, according to Deputy Sheriff A. G. Flippen of Yellville, Marion county, who arrived here to take charge lt;f Davenport today. The prisoner has been indicted on charges of carrying a pistol and giving ii-pior to minors, but the principal reason the officers have made such strenuous efforts to locate him for many months is that he is wanted by the prosecution to he used as a witness against his brother, Russell Davenport, who shot and killed their father. Thomas Davenport, in Marion county, in February, 1910. The killing, Mr. Flippen states, was the result of family troubles, the elder Davenport and his wife having separated and the two sons having taken the part of their mother. The man accused of the killing was indicted for murdei in the first degree, but after one mistrial he was 'admitted to bail in the sum of $10,000. Joe Davenport, who was arrested in this county by Constable Gilmore this week, is said to be considered an important witness for the state, but has eluded the officers until he was taken into custody by the Faulkner county official. Mr. Flippen and his prisoner will leave fo/ Yellville tonight.
